Are you ready for the Conveyancing Protocol?
The protocol changes are aimed at streamlining the process and reducing the number of steps at each stage. The changes will not be onerous as most firms are used to working within the protocol framework. It is, however, important to refresh your processes and ensure protocol application is up to date across your firm.
A major reason for the new code is to put the burden of detecting fraudulent sellers onto the seller’s solicitor (driven by Dreamvar (UK) Ltd v Mishcon de Raya and P&P Property Ltd v Owen Catlin LLP) which was also addressed by the May 2019 update to the Completion by Post Code.
